  1. Conditions for Exporting Coal: For coal to be exported, the following conditions must be met simultaneously

a) The coal has been processed and meets the specified quality standards or equivalent standards outlined in Appendix I of the Circular.

 b) The coal has a lawful origin as per Circular No. 14/2013/TT-BCT, which defines the conditions for coal trading. 

c) Compliance with other relevant regulations on import and export activities as imposed by the government.

  3.Coal Export Procedures: 

3.1. Documents required for Mangrove Charcoal import procedures

a) Sample analysis sheet confirming conformity with quality standards, issued by a laboratory meeting VILAS standards. 

b) Documents substantiating the lawful origin of the exported coal.

3.2. Documents proving the lawful origin of exported coal may include

a) For coal mining enterprises: Valid mining license or salvage mining license granted by the competent state agency.

 b) For coal processing enterprises: Certificate of investment in a coal processing facility and a contract for the purchase of coal from a lawful origin for processing. 

c) For commercial enterprises engaged in coal import and export: Sale and purchase contract accompanied by a copy of the value-added invoice or an entrustment contract for import with the enterprise mentioned in point a or point b. Alternatively, valid documents pertaining to the purchase of confiscated and sold coal by competent state agencies can be provided.

3.3. Customs clearance procedures 

If there are suspicions that the exported coal shipment does not meet the prescribed quality standards, the border-gate customs office may grant customs clearance but also take a coal sample for inspection. The inspection is conducted by a laboratory meeting VILAS standards. If the test results confirm the suspicion, the exporting enterprise will face administrative sanctions and bear the testing costs. Conversely, if the inspection confirms compliance with quality standards, the cost of testing will be borne by border-gate customs.
